This (including any modification/alteration/change/deletion/correction in this Agreement from time to time by Consultogy.com) is a Contract between you (User/Consultant) and Consultogy.com

Free Consent

You are fully stating that the initial fact as you have visited or you may visit Consultogy.com is a complete full-fledged acceptance of you towards various terms and conditions that are detailed in the website along with there in the below disclaimer section of this given Agreement. You have fully accepted and understand with a sound presence of mind without any external force, official or any other pressure, any sort of influence, or any other coercion whatsoever on you, and you will hereby be fully bound in by the terms mentioned in the disclaimer as well as the terms mentioned on the website. You further also understand and undertake that if in case of any dispute or disagreement if arises out related to any obligation as a visitor on the Website Consultogy.com or you might be looking for the opinion or doubt, any query, consultancy or advice related to the services offered by consultogy.com mentioned in this Agreement then the Jurisdiction exclusively in order to file a lawsuit against you will be/shall be in the court of NEW DELHI only.

Eligibility

The Membership of a user/consultant can be void for the prohibited section on the Site. In order to use this site, you must require to be at an age/eligible to get into an agreement in accordance with the applicable laws of India and as per the law of your residing country. You yourself warrants by the use of this Consultogy.com that you have the capacity, right, and authority to enter into this Agreement, and you are readily accepting and abide by all entire terms and conditions that are mentioned in this Agreement.

You also have agreed to inform Consultogy.com of your subsequent disability/requirement/need to enter into this agreement.

At its own sole discretion, Consultogy.com can change/restrict/terminated this Agreement from time to time without prior notice or any information.

Terms & Termination

This Agreement will be going to remain in full effect and force while you are using the services as a member of the website Consultogy.com. You are free with complete freedom to terminate or cancel your membership at any time as per your wish for any reason whatsoever by giving and information in writing to Consultogy.com over the mail support@consultogy.com to terminate your membership. As you terminate your membership, you will not be eligible nor allowed to claim nor we are bound to refund you the unused amount available in your account or the access to your content in your account through Consultogy.com. We at Consultogy.com in such case may terminate your complete access to the Site/ your membership for reason which shall be effective or best suited upon by sending notice/information of the of termination to you through the mode of the email address that you might have provided by you at the time of your registration for your membership on Consultogy.com or any other such email address that you might provide later in future to Consultogy.com. If in case Consultogy.com is terminating your membership due to the reason of your breaching this Agreement, you will be entitled/neither allowed to claim nor we are liable to pay any refund of any sort of unused Subscription fees or amount available in your account or any content available in your account. Even after this Agreement is terminated, there are certain provisions that will remain in effect and you will be bound by including sections 5-12, inclusive, of this given Agreement.

At any and every time Consultogy.com reserves the right to change/alter/delete/remove/discontinue any Service or features for any reason whatsoever and to suspend or cancel your subscription/membership of using services any time. This kind of suspension/cancellation may be without prior notice or maybe because of your inappropriate behaviour over the platform Consultogy.com. In such case of service suspension/cancellation, your right of using Consultogy.com to avail of the Service stops immediately. You will not able to access any data stored in your account or information once your service is suspended or cancelled and may not be restored or retrieved later.

You understand that Consultogy.com may at any time, at its sole discretion, and without prior notice to you, prohibit or restrict your access to the use of the website or related services.

Non-Commercial Use by Members

The Consultogy.com Site is only and only meant for the personal use of individual members, and may not/should not be used for any commercial purpose unless you are registered or appointed as a consultant on the site. This provides various links to other related websites, which may be deemed competitive to Consultogy.com or otherwise. Illegal/unauthorized/unlawful access or uses of this Site, including unauthorized framing/linking to Consultogy.com can be investigated at any time without prior notice/information and if found, appropriate legal action will be taken, which may include without limitation, criminal, injunctive, civil redress.

Consultogy.com in such case entitled and free to recover the amount of 50% of such profit/benefit/revenue along with the penalty from the amount you make as a revenue/profit/benefit etc. which you have expected, gained, received, or may go to receive in future by the unauthorized use of the site from your beneficiaries, heirs, successors, assigns, etc.

Other Terms of Use by Members

Be you are a User or a Consultant at Consultogy.com You are not allowed to engage in solicitation or any sort of advertising of any other member sell or buy services unless you are listed as an authorized advertising partner for Consultogy.com and the same need to be done only through Consultogy.com team members only. You are not allowed to circulate or share any letters, email chains, spam emails to any other member in any case whatsoever. Consultogy.com reserves and has the right to screen any such messages informed or comes to the notice or knowledge of the team of Consultogy.com.

Also, you may not be allowed or permitted to use any automated processes, including IRC Bots, EXE's, CGI, or any other scripts/programs to communicate/respond/connect/contact/interact with other members of Consultogy.com or about Consulogy.com

Content Posted on the Site

Consultogy.com owns and retains all proprietary rights, including without limitation, all intellectual property rights in the Consultogy.com Site and the Consultogy.com Service. The Site contains the copyrighted material, trademarks, and other proprietary information of Consultogy.com, and its licensors. Except for that information that is in the public domain or for which you have been given express permission by Consultogy.com, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. All lawful, legal, and non-objectionable messages (in the sole discretion of Consultogy.com), content, and/or other information, content, or material that you post on the forum boards shall become the property of Consultogy.com. Please note under this Agreement the liability of Consultogy.com strictly limits and we are not providing warranties of the services delivered from our site. Also, this agreement limits the solutions and consulting services.

Any data, interpretation, consultation, or information in any form received through Consultogy.com should not be treated as a substitute for advice or treatment you would normally receive from medical consultants, financial consultants, legal & law consultants, and other such authorized services.

Consultogy.com and its consultants, agents, affiliates, employees, officers, agents, partners, subsidiaries, and licensors are not providing any warranties of any kind, whether asked or offered, including, but there are no warranties available in regards to the services, consultation, advice, suggestion offered from the medium of Consultogy.com

Consulting services offered through Consultogy.com are based on cumulative or individual knowledge, experience, and interpretations of consultants and as such it may wary from one consultant to another.

Consultants on the panel of Consultogy.com may from time to time make recommendations of using Strategy, Approach, Scheme, Study etc to be used by you. Such recommendations are being made in good faith by the Consultant based on his/her individual though and views, hence Consultogy.com and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors make no warranty that

• the service will meet your requirements
• the service will be uninterrupted, timely, secure or error-free
• the results that may be obtained from the use of the service will be accurate or reliable
• the authenticity of any, services, information, etc. or obtained by you through the service will meet your expectations
• any errors in the software will be corrected
• information given is in sync with your situation or help in resolving your doubt or any similar or different use case whatsoever.

You are required to make full disclosure about the emotional, mental and physical state of the person seeking advice from the consultant of Consultogy.com so that the consultant makes an informed judgment about giving advice.

Consultogy.com is not taking any responsibility, liability nor is liable for any kind of data or monetary loss because of downloading or accessing any data in regards to use the services of the platform and you are doing it at your own sole risk. Also, in case of any damage to your computer, system, laptop, etc. consultogy.com is not at all liable or responsible for such loss in any case whatsoever.

The Managmement of Consultogy.com reserves and holds the right, in its sole discretion to Update, Change, Modify or remove Terms and Conditions thereof at anytime without prior information or notice of the same to you. Limitation on Liability:

You expressly understand and agree that Consultogy.com and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Consultogy.com has been advised of the possibility of any damages), because of

• the cost of purchasing of suggested goods and suggested services may result from any product, set of data, set of information or any other services purchased, procured or obtained or any messages received or any transactions entered into through or from the time of the service
• unauthorized access to or alteration of your transmissions or data
• statements, advice or suggestion of using any other third-party services
• any other matter relating to the service. Not withstanding anything to the contrary contained herein, Consultogy.com has no liability to pay you for any cause whatsoever, and regardless of the form of the action, will at all times is limited to the amount paid, if any, by you to Consultogy.com, for the service during the term of membership.

Disputes

Any claim in relation to this agreement or in connection therewith shall be filed with the opposite party within 6 months from the date when the claim first could be filed.

In case of any dispute including, involving, or about using the consulting services or in regards to the site, then by using our consulting services you further agree that all such the disputed matter will be governed and resolved by the laws of India. Also, you agree that the exclusive jurisdiction for all such disputes will be the courts of NEW DELHI, India.

Assignment

Consultogy.com may assign this contract to anybody with or without notice to you. Your membership/contract/subscription is non-transferrable and cannot be assigned to anybody without getting prior written approval/consent from Consultogy.com. Any such transfer/assignment by you without getting the approval of Consultogy.com shall be void.

Indemnity

You agree to indemnify and hold Consultogy.com, its subsidiaries, directors, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by, or for any third party because of or arising out of the use of your Service in order of violation of this Agreement and/or arising from a breach of any of the terms and conditions of this Agreement and/or any kind of breach of your any kind of representations and any warranties set forth above.

Dealings With Advertisers

Any of your communication/conversation/correspondence or any business dealings with, or in participation in any promotions of, or advertising found on or through the Service on Consultogy.com, including payment for any services, and any other terms, warranties, and conditions, or any communication/representations associated with any such dealings, are solely and solely between you and the advertiser. You agree that Consultogy.com shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or due to the result of the availability/presence of any such advertisers on the site. We suggest the customer inform immediately about any such advertiser to Consultogy.com at support@consultogy.com.

Other

By becoming a Member of the Site / Consultogy.com Service, you agree to receive certain specific emails and SMS from Consultogy.com.

This Agreement, accepted upon use of the Site and further affirmed by becoming a Member of the Consultogy.com service, contains the entire agreement between you and Consultogy.com regarding the use of the Site and/or the Service. Also, all the Terms & Conditions of this Agreement shall continue/applicable/imply on you in full force and effect.

As per this Agreement, you are bound under an obligation to report at support@consultogy.com about any misuse or abuse of the Site. If you notice any abuse or misuse of the Site or anything which is in violation of this Agreement, you shall forthwith report such violation to Consultogy.com by writing to Customer Care at support@consultogy.com. On receipt of such complaint, Consultogy.com may investigate such complaint and if necessary, may terminate the membership of the Member responsible for such violation abuse, or misuse without any refund of subscription fee. Any false complaint made by any Member is self-responsible and liable for the termination of his / her membership without claiming any refund of the subscription fee in any case whatsoever.

Consulting reserves the right to withdraw its services to any customer who is found to be unreasonable or abusive during their conversation with a consultant regardless of the reason. While Consultogy.com will make every effort to resolve any such situation, in case this fails, such customers will be sent a written warning. If the same is repeated, the said customer who is at fault will be stopped from using any kind of services and will not able to transact on the platform Consultogy.com. Any balance in the customer's wallet in such a scenario will not be refunded in any case whatsoever.

Consultogy.com is a trademark of Essensemotive Consulting India Private Limited. By joining Consultogy.com, you confirm that you have read the above provisions and agree to abide by them.

• This platform is meant to make you connected to the Consultant across industries in real time and we try to facilitate our services to get you connected to the right consultant for you work. But across platform we never assure you for any services under any categories that the consultant will sure do it for you. The work done is sole based on you , your credentials, your connection,your presentation and the interest of the consultant.

• Kindly don't login from multiple devices at the same time, if doing so then you may experience call get disconnected at one device but it's running on The other device. Call once disconnected, it means it's disconnected and your amount is deducted and if it shows your call is running, it's simply because of network or may be logged in into another device too. But rest assured your money will not deduct again.

Refund & Cancellation

As no refund request will be entertained or considered for the fake or incorrect data entered provided by any customer (Be it User or Consultant) on Consultogy.com. However, if you e-mail us at support@consultogy.com within an hour of registering on our platform, we will consider the changes to be made.

The services offered by Consultogy.com are not meant to replace any philosophical, emotional, or medical treatment. It is offered here as a service. Consultogy.com holds no responsibility or liability for the accuracy of the consultation provided to the customer.

Phone Advice

We advise and suggest the customer please ensure about your availability and presence are in the full network/signal coverage area and also you need to make sure that you answer the phone when it rings. Any call once connected gets disconnected because of a bad network/signal, will not be refunded in any case whatsoever.

About Consultant

We at Consultogy.com never assure, ensure, or agree to provide new customers to the consultant. We are here just to optimize and streamline your existing customers and call. We never ensure about the amount of revenue you are going to generate at Consultogy.com. Also, Consultant need to promote the Consultogy.com among their own clients in order to get the revenue from them and will be sole responsible for the same as Consultogy.com nowhere holds responsibility or responsible for generating revenue for the consultant. At the earning of the Consultant, Consultogy.com will deduct the tax if applicable as per government laws of income on the revenue generated by the consultant.

Transfer to Bank

At Consultogy.com, consultant has full freedom to transfer the earned amount of revenue to his/her own bank account as per their convenience whenever they want.

Multiple Domain Listing

At Consultogy.com, we allow consultant to list him/her in Multiple consulting domain in which they have a good knowledge.

Applicable Taxes

GST will be applicable on Membership Fees of Consultant & TDS will be applicable on the earning of the Consultant and will be deducted at the time of Transferring the earnings to the Bank.

Details of Consultant

Consultant need to enter all his valid details, as presenting or entering inappropriate or fake details may result to the suspension of the Consultant Account, in case of suspension refund will not be provided for the membership fee /earning / referrals of the consultant as the use of the account will be immediately stopped.

Consulting By Consultant

At Consultogy.com, when Consultant is consulting the user Via any medium Call, Chat, Video Call-------In such case consultant need to ensure that “to the point Consulting” in terms of the queries of the user. Also, if we found complaint, or report related to the unnecessary stretch or irrelevant consulting is delivered by the consultant and the same is repeated twice or more then the Consultant account will be immediately suspended with zero refund and consultant will not be able to access the account again in any case whatsoever.

Wrong Transfer

At Consultogy.com, we confirm account details with the consultant before sending amount to the bank and in case the account is wrong and incorrect still the consultant has transferred the amount so in such case of Wrong Transfer, Consultogy.com will not be liable nor responsible for any loss of amount to the consultant, neither Consultogy.com will help or support in the same. As consultant is transferring the amount in the account at their individual sole risk only.

Online to Answer

At Consultogy.com, we respect everyone time and want others to respect the same. So, consultant need to ensure that they answer each and every call whenever they are online, as not answering impacts their individual profile also the credibility of Consultogy.com, which will not be accepted in any case whatsoever. If, any consultant we see missing the calls and not responding properly this will going to be treated immediately with prompt action of suspending the account of the consultant without any prior notice, no refund of earning or referral can be claimed by the consultant. Also, penalty of INR 10000/- + GST will be applicable as a fee of Reactivating the account of the consultant.

No to Sharing Personal Details

At Consultogy.com, if any Customer or Consultant is found sharing his/her contact or personal details, immediately the account of the person will be suspended and no refund will be issued in any case whatsoever. Also, in this case user or consultant will not able to claim refund from Consultogy.com
